The most common malpractice claim against workers' compensation attorneys is failure to file within the statute of limitations. LC 5405 provides one year. LC 5410 provides five years. The average payout exceeds $150,000.
Type SOL scan. The system queries every open case, computes SOL and jurisdiction dates from the date of injury, checks whether a DOR has been filed, and produces a three-tier report:
- DANGER — cases with SOL expired or within 90 days
- WARNING — cases within 91-180 days
- NO STATUTES CALENDARED — cases with no statute events in the system
The third category is often the most concerning. These are cases where the intake process did not create a statute event. They are invisible to any calendar-based tracking system.
